Welcome to Luxequire. The terms “we,” “us,” and “our” refer to Luxequire. Luxequire is the commercial name of Sweet Home Center, a sole proprietorship registered in Quebec, Canada.
Luxequire operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with our online shopping services (the “Services”).
Luxequire is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (the “Terms”), describe your rights and responsibilities when using the Services.
Please read these Terms carefully. By accessing or using our Services or purchasing from Luxequire, you agree to be bound by these Terms and the policies referenced herein.
Nothing in these Terms is intended to exclude, restrict or waive any mandatory consumer right or legal warranty available under applicable Canadian or Quebec law.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your province or territory of residence, or that you have given your consent to allow any minor dependents under your responsibility to use the Services on devices you own, purchase or manage.
To use the Services, you may be required to provide information including your email address and billing, payment and shipping information.
You represent that the information you provide is accurate, current and complete and that you have the necessary right to provide such information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
SECTION 2 – OUR PRODUCTS
We make reasonable efforts to accurately display and describe the products offered through Luxequire.
However, product colours and appearance may vary depending on your device, screen settings and other technical factors.
Product descriptions, specifications, availability and other product information may be updated from time to time.
We reserve the right to discontinue products and, where permitted by applicable law, limit quantities or availability.
Nothing in this section limits any mandatory right relating to the accuracy of product descriptions, advertising, representations or legal warranties under applicable law.
SECTION 3 – ORDERS
When you submit an order, you make an offer to purchase the products identified in your order.
Luxequire reserves the right to accept, decline or cancel an order where reasonably necessary, including because of product availability, suspected fraud, pricing or listing errors, payment authorization issues, shipping restrictions or other legitimate operational reasons, subject to applicable law.
If we decline, modify or cancel an order after payment has been received, any amount owed to you will be refunded through the appropriate payment method.
Please review your order carefully before submitting it.
Because orders may be processed quickly, we cannot guarantee that a modification or cancellation request can be completed after an order has been submitted.
This does not limit any cancellation right available to consumers under applicable law.
Returns and refunds are governed by our Refund Policy.
SECTION 4 – PRICES, TAXES AND BILLING
All prices displayed on Luxequire are in Canadian dollars (CAD) unless otherwise expressly stated.
Unless otherwise indicated, product prices are displayed before applicable taxes.
Applicable GST/HST, QST and other applicable provincial or territorial sales taxes are calculated based on the order and delivery destination.
Shipping charges are disclosed in accordance with our Shipping Policy and, where applicable, during checkout.
Prices, promotions and discounts may change without notice, but changes will not retroactively affect an order already accepted, except where permitted by applicable law.
You agree to provide accurate and complete billing and payment information.
SECTION 5 – SHIPPING AND DELIVERY
Luxequire currently ships within Canada only, excluding Nunavut.
Our standard estimated delivery timeframe is 3–7 business days after shipment for eligible destinations.
Delivery times are estimates and are not guaranteed.
Shipping may be affected by circumstances outside our reasonable control, including severe weather, carrier disruptions, postal interruptions, statutory holidays and unusually high shipping volumes.
However, nothing in these Terms or our Shipping Policy excludes or limits any mandatory delivery, cancellation, refund or other rights available to consumers under applicable law.
For consumers protected by the Quebec Consumer Protection Act, applicable statutory rights concerning distance contracts and delivery remain fully applicable.
Luxequire remains responsible for fulfilling its obligations as merchant and will work with the applicable carrier to investigate packages that are lost, damaged or otherwise affected during transportation.
The mere transfer of a shipment to a carrier does not waive or restrict any mandatory right or remedy available to the consumer under applicable law.

SECTION 6 – INTELLECTUAL PROPERTY
The original content of Luxequire, including its original website content, branding, graphics, written materials, design elements and other original materials, is owned by Sweet Home Center or used under applicable authorization and is protected by applicable Canadian and international intellectual property laws.
Product photographs, manufacturer logos, trademarks, technical descriptions, promotional materials and other third-party content remain the property of their respective manufacturers, brands, licensors or other rights holders.
Luxequire may use such materials in connection with the legitimate marketing and resale of products offered through our store.
Nothing in these Terms transfers ownership of third-party trademarks or intellectual property to Luxequire or Sweet Home Center.
You may use the Services for lawful personal purposes. Except as permitted by applicable law or with the appropriate rights holder’s authorization, you may not reproduce, distribute, modify or commercially exploit protected content from the Services.
“Shopify” and related Shopify names, logos and marks are the property of Shopify or its applicable affiliates.
All other trademarks, product names, company names and logos appearing through the Services remain the property of their respective owners.
SECTION 7 – OPTIONAL TOOLS
We may provide access to tools or services offered by third parties.
Unless otherwise required by applicable law, such third-party tools may be provided on an “as is” and “as available” basis.
Your use of third-party services may also be governed by the terms and privacy practices of the applicable third party.
Nothing in this section excludes rights that cannot legally be excluded.
SECTION 8 – THIRD-PARTY LINKS
The Services may contain links to websites or services operated by third parties.
Luxequire does not control all third-party websites and is not responsible for their independent content, policies or practices.
Before entering into a transaction with a third party, you should review the applicable third party’s terms and policies.
Nothing in this section limits any responsibility that Luxequire cannot legally exclude under applicable law.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Luxequire is powered by Shopify, which provides the ecommerce technology that enables us to offer the Services.
However, purchases made through our store are transactions between you and Luxequire / Sweet Home Center.
Sweet Home Center remains the merchant responsible for Luxequire’s products, customer service, order fulfilment and applicable obligations to customers.
Shopify’s involvement as our ecommerce platform provider does not replace Luxequire as the merchant from whom you purchase products.
SECTION 10 – PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable privacy legislation.
Because our store is powered by Shopify, Shopify may also process personal information as necessary to provide its ecommerce services.
Please review our Privacy Policy for information regarding the collection, use, disclosure and protection of personal information.
SECTION 11 – FEEDBACK
If you voluntarily provide reviews, comments, suggestions or other feedback regarding Luxequire or our Services, you grant us a non-exclusive, worldwide, royalty-free right to use such feedback for legitimate business purposes, including operating, improving and promoting our Services, subject to applicable law.
You represent that you have the necessary rights to provide such feedback and that it does not unlawfully infringe the rights of another person.
SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, availability or other information.
We reserve the right to correct genuine errors and update information, subject to applicable consumer protection law.
Nothing in this section permits Luxequire to disregard a binding contract or mandatory consumer right where applicable law provides otherwise.
SECTION 13 – PROHIBITED USES
You may use the Services only for lawful purposes.
You must not use the Services to violate applicable laws, infringe intellectual property rights, transmit malicious software, engage in fraud, impersonate another person, collect personal information unlawfully, interfere with the security of the Services or otherwise misuse the Services.
We may restrict or terminate access where reasonably necessary because of misuse, fraud, security risks or violation of these Terms, subject to applicable law.
SECTION 14 – AUTOMATED AGENTS
Automated systems, software agents, scraping tools or similar technologies accessing the Services must comply with applicable laws, technical access restrictions and any reasonable security measures implemented by Luxequire or Shopify.
Automated systems must not circumvent security controls, CAPTCHA mechanisms, access restrictions or other measures designed to protect the Services.
SECTION 15 – TERMINATION
We may restrict or terminate access to the Services where reasonably necessary, including for violation of these Terms, fraud, security concerns or unlawful activity.
Termination does not affect obligations, payments or rights that arose before termination.
Provisions that by their nature should survive termination will remain in effect.
SECTION 16 – LEGAL WARRANTIES AND DISCLAIMER
Products sold to consumers may be covered by legal warranties that apply automatically under applicable law.
For Quebec consumers, these legal warranties include, where applicable, warranties that goods are fit for their ordinary purpose, have reasonable durability considering their price, terms and conditions of use, are free from hidden defects, and conform to their description and representations made concerning them.
These legal warranties apply independently of any manufacturer’s or additional commercial warranty.
Nothing in these Terms excludes, restricts or waives any legal warranty or mandatory consumer protection right.
Except for rights and warranties that cannot legally be excluded, the Services themselves are provided on an “as is” and “as available” basis.
SECTION 17 – LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Luxequire and Sweet Home Center will not be liable for indirect, incidental, special or consequential damages arising solely from the use or inability to use the website or Services where such liability may lawfully be limited.
However, nothing in these Terms excludes, restricts or limits liability where such exclusion or limitation is prohibited by law.
In particular, nothing in these Terms limits:
- mandatory consumer rights;
- applicable legal warranties;
- remedies available under the Quebec Consumer Protection Act;
- liability that cannot legally be excluded or limited; or
- any other mandatory protection provided by applicable Canadian or Quebec law.
For Quebec consumers, any limitation or exclusion of liability contained in these Terms applies only to the extent permitted by applicable law.
SECTION 18 – INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify Luxequire and Sweet Home Center against third-party claims resulting from your unlawful use of the Services, violation of these Terms or infringement of another person’s rights.
This provision does not impose liability on a consumer where doing so would be prohibited by applicable consumer protection law.
SECTION 19 – SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be limited or severed only to the extent necessary, and the remaining provisions will continue to apply where legally permitted.
SECTION 20 – WAIVER; ENTIRE AGREEMENT
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision.
These Terms, together with the policies incorporated by reference, constitute the agreement governing your use of the Services, subject at all times to mandatory applicable law.
SECTION 21 – ASSIGNMENT
You may not assign your rights or obligations under these Terms without our prior written consent where such consent may lawfully be required.
Luxequire may assign its rights and obligations in connection with a legitimate transfer or reorganization of the business, subject to applicable law and without reducing any mandatory consumer right.
SECTION 22 – GOVERNING LAW AND JURISDICTION
These Terms, the use of the Luxequire website and transactions made through Luxequire are governed by the laws of the Province of Quebec and the applicable federal laws of Canada.
Subject to mandatory consumer protection laws, disputes relating to these Terms, the Services or transactions with Luxequire may be submitted to the competent courts of the judicial district of Joliette, Quebec, Canada.
However, this jurisdiction provision applies only to the extent permitted by applicable law.
Nothing in these Terms prevents a consumer from bringing a claim before another court or judicial district where mandatory consumer protection legislation grants the consumer the right to do so.
Mandatory provisions of the Quebec Consumer Protection Act and other applicable consumer legislation prevail over any conflicting provision of these Terms.

Section headings are provided for convenience only and do not affect the interpretation of these Terms.
SECTION 24 – CHANGES TO THESE TERMS
We may update these Terms from time to time.
The most current version will be available on this page.
Where required by applicable law, customers will be notified of material changes.
Changes will not deprive consumers of rights arising from transactions completed before the changes where applicable law provides otherwise.
